§ 1. General provisions
- These Terms & Conditions ("Terms") set out the rules for selling electronic access codes to
premium materials (the "Access Code") through the website wnex.pl (the "Site").
- The Seller is [Name / business name], [address], Tax ID: [Tax ID], email:
kontakt@wnex.pl (the "Seller").
- Orders may only be placed through the Site. The Seller does not accept orders by phone or in any
other form.
- Purchasing an Access Code does not require creating an account or registering — it is a one-time
purchase.
§ 2. Definitions
- Customer / Consumer — a natural person making a purchase not directly related to their
business or professional activity.
- Access Code — a one-time, electronic code unlocking access to premium materials on the Site,
valid for the period stated at the time of purchase.
- Digital content — data supplied in digital form (here: the Access Code and the materials it
unlocks), not recorded on any physical medium.
- Payment operator — SimPay (simpay.pl), the sole entity handling payments on the Site.
- Terms — this document.
§ 3. Ordering and conclusion of the contract
- An order is placed directly on the premium materials page by choosing one of the available
payment methods (§ 4).
- Placing an order requires providing: full name, email address, and phone number, and checking
the box accepting these Terms together with the consent described in § 6(2).
- The contract for the supply of Digital content is deemed concluded upon positive payment
confirmation from the Payment operator.
- The Seller does not offer installment or deferred payment options.
§ 4. Prices and payments
- Prices shown on the Site are gross prices in Polish złoty (PLN).
- Payments are handled exclusively by the Payment operator — SimPay — through the channels
available on the Site: BLIK (zero-redirect, code entered directly on the Site) and Premium SMS.
- The Seller does not accept cash, traditional bank transfer, or any channel other than those
listed in (2).
- The contract is concluded only upon positive payment confirmation — no confirmation means no
contract and no Access Code is delivered.
§ 5. Delivery of Digital content
- The Access Code is delivered exclusively by electronic means, to the email address provided by
the Customer when placing the order.
- The Access Code is sent immediately after payment is confirmed by the operator — for BLIK
typically within tens of seconds of approving the payment in the banking app, for Premium SMS
immediately after the SMS code is verified.
- The Access Code is valid for the period stated in the confirmation email from the date it was
granted, and is intended for use solely by the Customer who made the purchase.
- Digital content is deemed delivered at the moment the Access Code is made available to the
Customer (sent to the specified email address).
§ 6. Right of withdrawal
- Under consumer protection law, the Consumer has the right to withdraw from a distance contract
within 14 days without giving a reason.
- The right of withdrawal does not apply to contracts for the supply of Digital content not
delivered on a physical medium, if performance began with the Consumer's explicit prior consent
before the withdrawal period expired and after being informed that they would lose the right of
withdrawal once the Seller had performed. Checking the box described in § 3(2) at the time of
ordering constitutes such explicit consent and acknowledgment of this information.
- In cases where the right of withdrawal applies, refunds are made via the same channel used for
payment, within 14 days of receiving the withdrawal statement.
§ 7. Complaints
- Complaints regarding the Access Code or availability of materials may be submitted to
kontakt@wnex.pl, including a description of the issue and details identifying the order (the
email address used for the purchase, approximate purchase time).
- The Seller handles complaints within 14 days of receipt and informs the Customer of the outcome
at the email address the complaint was sent from (or specified in its content).
§ 8. Out-of-court dispute resolution
The Consumer may use out-of-court methods for handling complaints and pursuing claims, including
via the EU ODR platform available at ec.europa.eu/consumers/odr, and may seek assistance from the
locally competent consumer ombudsman.
§ 9. Personal data
The rules governing the processing of personal data provided at purchase (name, email, phone, and
transaction data) are described in the Privacy Policy.
§ 10. Final provisions
- The Seller reserves the right to amend these Terms for valid reasons (e.g. change in service
scope, change of Payment operator, changes in law). Amendments do not affect contracts concluded
before they take effect.
- Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code and
consumer protection law.
- These Terms apply from the date of publication on the Site.
